These Terms of Service ("Terms") govern your access and use of BodyCount, a private diary application with AI analysis developed by BodyCount SAS.

By creating an account or using our services, you agree to be bound by these Terms. If you do not accept these terms, please do not use our services.

1. Service Description

BodyCount is a mental wellness and personal introspection platform that allows you to keep a private journal, share anonymous confessions and benefit from personalized AI analysis.

2. User Accounts and Responsibilities

Account Creation and Management

  • • You must be at least 16 years old to create an account
  • • One email address per user account
  • • You are responsible for maintaining the security of your account
  • • Immediate notification required in case of unauthorized use
  • • BodyCount reserves the right to suspend or delete accounts

Data and Intellectual Property

  • • You retain all rights to the content you create
  • • You grant BodyCount a license to provide our services
  • • Your confessions remain anonymous and non-identifiable
  • • AI analyses generated belong exclusively to you
  • • Permanent deletion possible at any time

3. User Obligations

4. Prohibited Uses

Strictly Prohibited Behaviors

These actions may result in immediate account suspension

Harassment, intimidation or threats towards other users
Publication of hateful, discriminatory or violent content
Hacking, phishing or cyberattack attempts
Use of unauthorized bots or automation
Resale or transfer of credits to third parties
Creation of fake accounts or identity theft
Spam, unsolicited advertising or commercial content
Violation of local or international laws

5. Credit System and Payments

Transparent conditions for our economic model

Payment Policy

All payments are secured via Stripe

  • Instant and secure payments
  • Accepted methods: CB, Visa, MasterCard, PayPal
  • Automatic billing for subscriptions
  • Currency: EUR (Euros)

Credits and Usage

Credits are non-refundable once used

  • 30 free credits upon registration
  • 1 daily bonus credit
  • 10 credits per AI analysis
  • Credits valid for 12 months after purchase

Refunds

Specific refund conditions

  • Refund possible within 14 days if credits unused
  • No refund for already consumed credits
  • Automatic refund in case of malfunction

6. Liability Limitations

• BodyCount is provided "as is" without warranty of any kind

• We do not guarantee 100% service availability

• AI analyses are for informational purposes and do not constitute medical advice

• Our liability is limited to the amount paid for services

• We are not responsible for data loss due to force majeure

7. Termination

• You can delete your account at any time

• We may suspend your account for violation of conditions

• Unused credits may be refunded according to our conditions

• Deletion results in permanent erasure of all your data

• Conditions continue to apply after termination

8. Applicable Law

These Terms are governed by French law.

|Any dispute will be subject to the exclusive jurisdiction of the courts of Paris, France.

|In case of dispute, we favor amicable resolution before any legal action.

|European law provisions also apply (GDPR, DSA, etc.

).

9. Modifications

We reserve the right to modify these Terms at any time.

|Important modifications will be notified to you 30 days in advance by email.

|Continued use after modification constitutes your acceptance.
